Agency Relationships
Florida law requires real estate licensees to disclose their agency relationship with parties in a real estate transaction. We will provide you with written disclosure of our agency relationship before or at the time you enter into a listing agreement or offer to purchase property.
Transaction Broker Relationship
Unless otherwise agreed in writing, Baradit Professional Association will act as a Transaction Broker, providing limited representation to both buyers and sellers in real estate transactions. As a Transaction Broker, we facilitate the transaction without representing either party's interests exclusively.

Fair Housing Compliance
Baradit Professional Association is committed to full compliance with the Fair Housing Act and all applicable fair housing laws. We provide equal professional service without regard to race, color, religion, sex, handicap, familial status, national origin, sexual orientation, gender identity, or any other protected class under federal, state, or local law.
COMMISSION STRUCTURE DISCLOSURE
3% Total Commission Program
Our advertised 3% total commission structure is subject to the following terms and conditions:
1. Commission Payment Structure:
- The seller pays Baradit Professional Association a total commission of 3% of the final sale price
- If a buyer is represented by a licensed real estate agent, Baradit Professional Association may pay the buyer's agent a portion of this 3% commission when reasonably feasible
- The seller is NOT obligated to pay any additional commission or fee to the buyer's agent beyond the 3% total commission paid to Baradit Professional Association
- Commission split with buyer agents are at the sole discretion of Baradit Professional Association and will be determined based on market conditions, transaction complexity, and other relevant factors
2. "Reasonably Feasible" Definition:
The determination of whether it is "reasonably feasible" to compensate a buyer's agent from our 3% commission will be made by Baradit Professional Association based on factors including but not limited to:
- Market conditions and customary commission rates
- The complexity of the transaction
- Services provided by the buyer's agent
- Length of time on market
- Negotiated sale price relative to list price
- Other relevant transaction‑specific circumstances
3. No Guarantee of Buyer Agent Compensation:
While we strive to accommodate buyer's agents within our 3% commission structure, we cannot guarantee that all buyer's agents will accept the compensation offered. Some buyer's agents may require their clients (buyers) to supplement the commission paid by Baradit Professional Association.
4. Listing Agreement Required:
All commission terms must be clearly outlined in a written listing agreement signed by both the seller and Baradit Professional Association. The listing agreement will specify:
- Total commission percentage
- Commission payment terms
- Duration of listing
- Marketing plan
- Seller's obligations
- Broker's obligations
- Cancellation terms
5. Additional Costs:
The 3% commission covers brokerage services only. Sellers remain responsible for:
- Repairs only when negotiated and agreed upon in the purchase contract and signed by seller and buyer.
- Title insurance and closing costs when negotiated and agreed upon in the purchase contract and signed by seller and buyer.
- HOA transfer fees when negotiated and agreed upon in the purchase contract and signed by seller and buyer.
- Any other costs when negotiated and agreed upon in the purchase contract and signed by seller and buyer.
LISTING AGREEMENT TERMS
Flexible Duration
We offer listing agreements with minimum terms of 30 days and maximum terms as mutually agreed upon in writing. Unlike many traditional brokerages, we believe in earning your business through performance, not through restrictive long‑term contracts.
Cancellation Policy
Our listing agreements may be cancelled by either party under the following conditions:
No‑Fault Cancellation:
- Either party may request cancellation at any time
- Written notice of cancellation must be provided
- No cancellation fees will be charged
- No lawsuit threats or intimidation tactics
- Professional, courteous handling of all cancellation requests
Post‑Cancellation Obligations:
- If a buyer who was introduced to the property by Baradit Professional Association during the listing period subsequently purchases the property, the seller will NOT remain obligated to pay the commission as outlined in the original listing agreement unless otherwise agreed upon in writing by the seller and Baradit Professional Association.
- This protection period will be clearly specified in the listing agreement
Exception – Accepted Offers: If an offer has been accepted and a contract is pending at the time of cancellation request, the commission remains due and payable at closing unless otherwise mutually agreed in writing.
FORECLOSURE INTERVENTION SERVICES DISCLOSURE
Nature of Services
Through our sister website, ForeclosureUrgentCare.com (operated as BPA Urgent Foreclosure Solutions), we provide foreclosure intervention and consultation services. These services are designed to help property owners explore options when facing foreclosure or financial hardship.
Services May Include:
- Initial consultation and situation assessment
- Communication and negotiation with lenders (as a real estate professional)
- Explanation of available options (loan modification, short sale, deed in lieu, etc.)
- Referrals to qualified attorneys, credit counselors, and financial advisors
- Property listing and marketing services if the owner chooses to sell
- Timeline guidance and process explanation
Critical Limitations and Disclaimers

We are NOT attorneys, financial advisors, or credit counselors. We cannot and do not provide:
- Legal advice regarding foreclosure proceedings

2. No Guaranteed Outcomes:
We cannot and do not guarantee:
- That we can stop or prevent foreclosure
- That your lender will agree to any particular solution

3. Time‑Sensitive Nature:
Foreclosure proceedings move quickly and are governed by strict legal deadlines. The earlier you seek help, the more options you may have available. Waiting until the last minute may severely limit available options.
4. Lender Communication:
While we can assist with communicating with your lender as a real estate professional, we are NOT acting as your legal representative. We cannot:
- Represent you in court
- Negotiate legal modifications to your mortgage (we can facilitate communication, but legal modifications require attorney involvement)
- Challenge the validity of the debt
- File legal motions or responses
5. Credit Impact:
Many foreclosure alternatives (short sales, deed in lieu of foreclosure, loan modifications) may still negatively impact your credit. We recommend consulting with a qualified credit counselor to understand the credit implications of any decision.
NO UPFRONT FEES POLICY
Foreclosure Services
For foreclosure intervention services, Baradit Professional Association and BPA Urgent Foreclosure Solutions operate on a NO UPFRONT FEES basis:
- You will NOT be charged any fees for initial consultation
- You will NOT be charged any fees for our assistance in communicating with your lender
- You will NOT be charged any fees for exploring your options
- You will NOT be charged any fees for referrals to attorneys or other professionals
If You Choose to Sell:
If you decide that selling your property is the best option and you list with Baradit Professional Association, standard real estate commission will apply as outlined in the listing agreement. Commission is paid ONLY at closing from the proceeds of the sale.
If You Choose Not to Sell:
If you decide not to sell your property, you owe us nothing. There are no fees for consultation or lender communication assistance.
Traditional Real Estate Services
For traditional real estate listing services (non‑foreclosure situations), our commission structure applies as outlined in the Commission Structure Disclosure section above. No upfront fees are charged; commission is paid at closing.
CREDIT REPAIR SERVICES DISCLOSURE
Scope of Credit Services
Baradit Professional Association provides limited credit repair services in connection with real estate transactions. Our services are designed to help clients improve their credit profiles to facilitate property purchases or to recover after foreclosure.
NOT Credit Counselors
We are NOT licensed credit counselors. Our credit repair services are supplementary to our real estate services and are limited in scope. For comprehensive credit counseling, we recommend working with a HUD‑approved credit counseling agency.
Credit Repair Organizations Act Compliance
To the extent our services fall under the Credit Repair Organizations Act (CROA), we comply with all requirements including:
Required Disclosures:
- You have the right to dispute inaccurate information in your credit report by contacting the credit bureau directly
- You may obtain a free copy of your credit report annually from each of the three major credit bureaus at www.annualcreditreport.com
- You have the right to dispute inaccurate information with credit bureaus yourself, free of charge
- Credit repair companies cannot require advance payment
- Credit repair companies cannot make false claims about their services
- You have the right to cancel any contract for credit repair services within three business days

No Guarantee of Sale
